Israel's Justice Ministry has finished drafting a bill that would allow children under 14 to be sentenced to jail, Israeli sources reported.
Under the bill, which was drawn up by Israeli Justice Minister Ayelet Shaked, jail sentences could be handed down to children as young as 12, though the offender would start serving the sentence only when he turned 14.
Prison sentences could be imposed on children younger than 14 only if they are convicted of murder, attempted murder or manslaughter, the draft bill states, according to Al Ray.
Israeli sources reported that, if the bill is passed into law, Israel would become one of only a few Western countries which allow prison sentences for children under 14.
The Justice Ministry started drafting the bill after the arrest of 13-year-old Ahmad Manasra, who was convicted of an alleged stabbing attempt, last month.
Under Israeli law, Manasra could not be sentenced to jail, but it allows his detention, interrogation and, then, a stint in a closed treatment facility until the age of 14.
Under currentl Israeli law, children below age 12 are considered below the age of criminal responsibility and cannot be subjected to criminal proceedings at all. Children aged 12 or 13 can be arrested and tried, but they can’t be sentenced to jail unless they have turned 14 by the time the sentence is handed down. Instead, they can be sent to closed treatment facilities and kept there until age 20.
Under the bill now being drafted, a judge could instead sentence the child to jail, though he or she would be kept in a closed treatment facility until the age of 14. At that point, he would be sent to prison to serve out his sentence, but only after a hearing at which the judge would have to confirm the decision to transfer him to jail.
The bill makes no distinction between juveniles convicted of a terror-motivated crime and those convicted of other crimes.
Israeli MK Anat Berko submitted a bill of her own on the issue. Her bill, too, provides for the incarceration of 12 and 13-year-old offenders in a closed treatment facility until the age of 14. However, it differs from the government bill in that it allows children under 14 to be given prison sentences only if convicted of terrorist crimes.
Yitzhak Kadman, executive director of the Israel National Council for the Child, said he opposes both bills.
“Hard cases don’t make good law,” he said. “As a result of the situation and the terrible incidents that have occurred, there’s pressure to find quick solutions. But restraint in legislation is strength, not weakness. We need to consider the ultimate ramifications of this.”

Ekafi has been on hunger strike for 38 days in protest against his renewed administrative detention according to which he is held in Israeli jails without charge or trial.
During his hunger strike, Eskafi suffered very sharp health deterioration after his substantial weight loss.
Eskafi has suspended his hunger strike after he received a promise to renew his detention for one last time for four months starting from November to be then released on February 2016, the Center explained.
Eskafi was arrested on November 2014 after spending six years in Israeli jails in previous arrests.

The number of detained minors and children in the Israeli Jafon prison has risen to 62 prisoners, suffering from torture and humiliation, which has become the routine method practiced by the Israeli security forces against prisoners without taking into account their age.
The Palestinian Prisoner Society’s lawyer, Fawaz Alshalodi, after visiting the prison on Tuesday, said that the majority of the prisoners languishing in it have been tortured with beating, severe beating, obscene insults and other methods of torture.
The PPS statement added that the prison, which has been opened last October due to the increase in arrest cases among children and minors, is still not ready to receive the security prisoners, as the prison's administration deals with them as criminal prisoners and did not allow an adult prisoner to represent and guide minor prisoners as is the case in other prisons.
The minors confirmed that the prison's administration storms the section from time to time, searches their belongings, beat them up, and imposes sanctions on them such as isolation, tying them to beds, and imposition of fines.
They also complained of the poor quality and quantity of food provided to them which they often refuse to eat, in addition to the lack of winter clothes and hot water. The prison administration also refuses to convert those who are ill to the clinic for medical tests or to provide them with treatment. Besides, some of them are deprived of family visits or communicating with their relatives on the phone.
In the same context, the lawyer documented a number of minor Jerusalemites prisoners' testimonies who were tortured from the moment of their arrest, including captive Mufeed Ziad Saeeda, 16, who was severely beaten during his arrest and interrogation process, in addition to forcing him to sit in a squat position with his face toward the wall for three successive hours during which he was repeatedly slapped on the back of the neck.
The captive added that after being transferred to the Maskobiye detention center, he wanted to sleep as he was suffering from severe fatigue after the torture he was exposed to; the jailers threw him from on the floor of the cell, beat him, and strip-searched him. He pointed out that he was also beaten after being transferred to Jafon prison.
Minor Alaa Ibrahim Obaid, 17, was arrested by the Israeli occupation forces (IOF) from a football field and was beaten all over his body. Then when he demanded one of his parents be present with him in the interrogation according to the law, his request was rejected, and he was beaten again. The prisoner added that all that was accompanied by obscene insults.
The captives Ahmed Khalil Rowedi, 17, and Mohammed Wael Abu Shama, 16, said that the IOF assaulted them with beating and obscene insults throughout the process of arrest and interrogation.

At least 33 Palestinian citizens, including four patients, have been kidnapped by the Israeli occupation forces (IOF) at the Erez border crossing, in northern Gaza Strip, since the start of 2015, the Mezan Center for Human Rights reported Tuesday.
The Mezan rights group said in a press release the Israeli occupation army has made use of its control over the Erez border crossing to tighten its grip around Palestinians’ necks.
The group reported 33 cases of arbitrary abduction, including 24 merchants and four patients.
Over recent months, the Israeli occupation has stepped up arbitrary arrests of Palestinian merchants and patients, along with several other humanitarian cases, most of whom have been in urgent need of travel.
The group slammed Israel’s increasing and flagrant violations of international and humanitarian laws.
The statement urged the international community to urgently intervene and work on lifting the tough siege on Gaza.
The Mezan center further condemned Israeli aggressions on Palestinian civilians and the permanent closure of border-crossings.
The rights group referred to a propagated video on the harsh torture jailed Palestinian minor Ahmad Manasra has been subjected to as a conclusive proof of Israel’s inherently sadistic and anti-humanitarian policies.

VIDEO: Abusive Interrogation of Palestinian Teen Ahmad Manasra
This controversial video shows clips of the interrogation of 13-year-old Palestinian child, Ahmad Manasra, as Israeli occupation detectives curse and verbally abuse Manasra, in questioning him about the incident and his alleged motives.
The time of which the footage was recorded is not known.
On Oct. 30, Israel's Jerusalem District Court indicted 13-year-old Manasra on charges of attempted murder following an attack on two Israelis settlers, according to Israeli media.
The event took place on Oct. 12, in Jerusalem.
In the video, one interrogator repeatedly shouts at Manasra, in Arabic, to "shut up", as Manansra continuously pleads for the officer to believe that he cannot remember anything about the incident.
The officer is then seen questioning the boy about a phone call with his lawyer, and then tells him that he is accused of the attempted murder of "two Zionist Jews", and that Manasra had supported "the enemy in time of war", which Manasra does not seem to understand.
The interrogator is next recorded showing Manasra a video of the attack, shouting questions at him about details of the incident. Manasra starts to cry as he says that he "doesn't know" and "cannot remember," pleading with the officer to "take me to the doctor to check me," all while hitting himself on the head.
Manasra continues to say that "he cannot remember anything," begging the detective to believe him, and adds that he "woke up the next day not knowing what had happened to me."
The detective continuously calls Manasra a "liar".
Another interrogator joins the first, as he continues to ask him about his motives, Mansara finally says, "Everything you're saying is correct, I cannot remember. From what I've seen on the camera [of the original incident] it's 100 percent correct, but I cannot remember anything."
The two interrogators are seen smiling as they discuss details of whether he was holding the knife up or down. Manasra tells the investigator, "you've been asking me about it all along and you don't know if the knife was held up or not."
The second interrogator starts shouting at Manasra and asking him about his motives. Manasra starts to cry, saying that he has "forgotten," again begging the men to "take me to a doctor to see if I remember."
During the attack, Ahmad's 15-year-old cousin, Hassan, was shot dead on site by Israeli occupation forces, while Ahmad was knocked over by an Israeli settler car and seriously wounded.
A video of Ahmad lying injured and bloody on the ground after being hit by the car was uploaded to social media and went viral. In the footage, a settler onlooker can clearly be heard saying: "Die, you son of a wh***! Die!", while another tells the police officer to shoot him until he dies.
Ahmad will reportedly be held in a closed facility until prosecution, with the court rejecting the family's request that he be placed under house arrest.
Last month, Israeli news site Ynet said that the cousins committed the attack after returning from school and discussing the Al-Aqsa Mosque and Gaza, before deciding to be "martyrs".
Also Israeli authorities have claimed that the boy had a knife, and said that he had made a threats with it.
Due to his age, Ahmad cannot face jail time until he turns 14, in January.
At least 81 Palestinians have now been killed since the beginning of October, as rights group call for Israel to halt "unlawful" killings of Palestinians who have not posed a great enough threat at the time of their death for the deliberate use of force to be permissible by Israeli forces.
At least 13 Palestinian children have been killed by Israeli forces in the unrest.
Rights group pushes for releasing child from Israeli jail
The Palestinian Prisoner Society (PPS) on Tuesday slammed Israel’s torture of the detained Palestinian minor Ahmad Manasra to force confession out of him, calling for his release before it is too late.
Head of the PPS Fares Qaddura said as he commented on a video showing Israeli investigators pressuring Manasra to force confession: “We’ve warned several times before against the crimes that have been going on inside the cellars of Israeli investigation cells.”
He called for bringing Israeli investigators before the court and for immediately releasing Manasra and granting him urgent medical therapy.
The activist said the video is a proof of the biased verdicts issued by Israel’s military judiciary against Palestinian captives.
He urged the human rights organizations to opt for practical steps in response to the oppressive measures adopted by Israeli military courts.
Qaddura slammed the silence maintained by the international human rights organizations vis-à-vis Israeli crimes against Palestinian captives, mostly children, saying such a silence rather helps the Israeli occupation perpetrate more crimes and violations against Palestinians.
He added that the video comes at a time when Israeli mass-abduction sweeps against Palestinian children have been dramatically on the rise and culminated in the abduction of at least 500 children in October.
Islamic-Christian Commission: Manasra Footage Reveals Israeli Cruelty
The Islamic Christian Commission for supporting Jerusalem and Holy sites considered a recently released video, showing the interrogation of the child Ahmad Manasra, 13, to be one simple example of Israeli violations and crimes against Palestinian children being held in Israeli prisons.
The Commission, in a statement, declared that the cruel method of interrogating Manasra, who is one of hundreds of Palestinian children in Israeli prisons, a flagrant violation of international laws and conventions. It noted that the footage of shouting at and rebuking Manasra, until they had achieved a state of extreme mental duress in the boy, is considered other incriminating evidence.
Defence for Children-Palestine has recorded a significant rise in the physical violence practiced against Palestinian children detained in Israeli jails. The data collected during the first part of 2015 revealed that 86% of detained children are subjected to more than one type of physical violence during interrogation, an increase of 10%, in comparison with 2014.
The Secretary-General of the Islamic Christian Comission, Dr. Hanna Issa, said that the Jerusalemite children are subjected to wide range of violations while being arrested. These measures include night detention, violence, handcuffing them without reason, interrogating them without the appearance of their parents, as well as banning them from going to the bathroom, and depriving them of water in order to force them to "confess".
Israeli occupation police violated the Israeli law of arrested children, even though these laws are implemented in east Jerusalem, he added, according to Al Ray Palestinian Media Agency.
The commission stated that Israel is the only country which tries children before military courts that lack the minimum requirements of a fair trial.
Article 37 of the International Convention on the Rights of the Child states that: No child shall be deprived of his or her liberty unlawfully or arbitrarily.
The arrest, detention or imprisonment of a child shall be in conformity with the law and shall be used only as a measure of last resort and for the shortest appropriate period of time; No child shall be deprived of his or her liberty unlawfully or arbitrarily. The arrest, detention or imprisonment of a child shall be in conformity with the law and shall be used only as a measure of last resort and for the shortest appropriate period of time.
