The occupation authorities turned to the policy of administrative arrests which is based on weak confidential evidence and intelligence information to detain a person and shut the hopes of defending him in the Israeli courts.
The administrative arrest orders recently increased against Jerusalemites in an attempt to slow down the Palestinians’ rise and break their steadfastness party of the policy of collective punishment practiced against Jerusalemites. Wadi Hilweh Information Center explained that the occupation authorities transferred 23 Jerusalemites including three minors to administrative arrest during one week following an order from the Minister of Occupation Army.
The center added that the Jerusalemite young men who were transferred to administrative arrest are from the village of Esawyeh, Silwan, Old City of Jerusalem, Sur Baher and Jabal Al-Mukabber; note that freed prisoners are among them.
The center also pointed out that transferring several prisoners to administrative arrest falls within the collective punishment policy recently practiced against Jerusalemites. Abdel Salam Abu Ghazaleh, father of Martyr Thaer Abu Ghazaleh, was transferred to administrative arrest while his son’s body is still being detained who passed away on the 8th of the current month in Tel Aviv after being shot under the pretext of carrying out a stabbing attack.
Also, the brother of prisoner Shurouq Dwayyat was also transferred to administrative arrest. Shurouq was accused of attempting to stab a settler in the Old City of Jerusalem on the 7th of October and was injured in her shoulder; she underwent a surgery and is currently imprisoned in Hasharon prison.
Lawyer Mohammad Mahmoud explained that the “administrative arrest” law was implemented during the British Mandate in the Palestinian lands and the occupation authorities are currently implementing this law against Palestinians following the orders of the Minister of Occupation Army when a Palestinian is arrested and the evidence against him aren’t enough to submit an indictment against him.
The lawyer added that arrested any person is based on intelligence information or testimonies by others or both combined but the evidence is weak and isn’t enough to submit an indictment. If the indictment gets submitted, the judge will decide to acquit the detainee and release him; that’s why the administrative arrest law us used.
Lawyer Mahmoud also explained that the public prosecution claims that the case is confidential to prevent the lawyer from defending the detainee or even looking at his file. Administrative arrest is imposed without any charges or trial and is based on “confidential” evidence that can’t be revealed to maintain the safety of the information’s sources.
He added: “After the Minister of Occupation Army issues the decision of administrative arrest, the public prosecution submits a request to the District Court within 48 hours to confirm the decision. The possibility of rejecting the request by the court is very minimal.”
The lawyer explained that a group of young Jerusalemite men were transferred last year to administrative arrest while more than 20 Jerusalemites were transferred to administrative arrest for periods between 3 and 6 months during the last few days; note that the periods are renewable.

Israeli police informed Fadi Hasan Abassi, 17, on October 20 that Israel’s Defense Minister, Moshe Ya’alon, issued an administrative detention order against him for up to six months.
Israeli authorities placed three Palestinian teenagers from East Jerusalem under administrative detention last week, the first time the measure has been used against Palestinian minors in nearly four years.In the early hours of October 19, Israeli forces arrested Fadi Hasan Abassi, 17, and Mohammad Saleh Ghaith, 17, from their homes in the East Jerusalem neighborhood of Silwan. They transferred the teenagers to Oz police station in the East Talpiot settlement, also known as Armon HaNetziv, in East Jerusalem. Abassi and Ghaith told Defense for Children International - Palestine that interrogators accused them of throwing stones at Israeli police vehicles, which they both denied. They appeared before the Jerusalem Magistrate Court separately on different dates and the judge extended their detention.
Israeli police informed Abassi on October 20 that Israel’s Defense Minister, Moshe Ya’alon, issued an administrative detention order authorizing his imprisonment for up to six months. On October 21, Israeli authorities notified Ghaith and his lawyer that a three-month administrative detention order was issued against him.
Israeli forces also arrested Kathem Mahmoud Sbaih, 17, in a predawn October 16 raid on his home in the East Jerusalem neighborhood of Jabel Mukaber. His father, Mahmoud Sbaih, told DCIP that an Israeli court upheld the three-month administrative detention order against his son on Monday. Administrative detention is the imprisonment of individuals by the state for prolonged periods without charge or trial.
“We are deeply disturbed that Israeli authorities have approved the detention of these three boys without charge or trial,” said Ayed Abu Eqtaish, Accountability Program director at DCIP. “Administrative detention must never be used as a substitute for criminal prosecution where there is insufficient evidence to obtain a conviction.”
Israeli forces transferred both Abassi and Ghaith to Mascobiyya interrogation and detention center in Jerusalem. On October 25, the two teenagers appeared before the Jerusalem District Court to confirm their detention orders, however, the presiding judge postponed the ruling until October 28.
According to sworn testimonies collected by DCIP, Israeli interrogators did not properly inform the Abassi and Ghaith of their right to remain silent or allow them to consult a lawyer prior to interrogation. Neither of them had a parent or family member present during interrogation.
In Jerusalem, Israeli authorities rely on Israel’s Emergency Powers Law to authorize the use of administrative detention. According to DCIP documentation dating back to 2000, Jerusalem minors had not previously been subject to administrative detention.
In the occupied West Bank, where military law applies to the Palestinian population only, Israeli Military Order 1651 permits administrative detention for a period of up to six months, subject to indefinite renewals. No Palestinian child from the West Bank has been held under administrative detention since December 2011.
According to Addameer, a Palestinian prisoner rights group, at the end of September 2015, 343 Palestinians were held under administrative detention in Israeli prisons.
Tensions over access to the Al-Aqsa mosque in Jerusalem’s Old City escalated into lethal attacks across East Jerusalem and the rest of the occupied West Bank. The mosque lies in a compound known to Muslims as the Noble Sanctuary and to Jews as the Temple Mount. Both faiths consider the site sacred.
The move comes as Israeli ministers approved harsher sentencing guidelines and fines for stone-throwers.
Since October, DCIP has confirmed that Israeli forces killed at least 12 Palestinian children in separate incidents across the West Bank, including East Jerusalem, and the Gaza Strip.
International juvenile justice standards, which Israel has obliged itself to implement by signing the UN Convention on the Rights of the Child in 1991, demand that children should never be deprived of their liberty arbitrarily and their detention must be a measure of last resort.

The occupation forces raided on Tuesday the houses of Jabal Al-Mukabber Martyrs as well as the house of prisoner Shurouq Dwayyat.
Local sources from the village of Jabal Al-Mukabber said that the occupation forces raided the houses of Martyrs Mu’taz Aweisat (minor), Mustafa Khatib (minor) and Baha’ Alayan in the village of Jabal Al-Mukabber and also the house of prisoner Shurouq Dwayyat in the village of Sur Baher; special crews took pictures and measurements of the houses and also checked their walls.
Sources explained that the forces raided the surroundings of Khatib family house since no one was home and they don’t own the house; they’ve rented it for tens of years.

The Israeli police arrested Tuesday evening two Palestinian children in occupied Jerusalem for allegedly trying to carry out a stabbing attack.
The two minor detainees, aged 16 and 17, were arrested at the western entrance to the Old City while holding knives in their possession, Israeli police claimed.
The two minors were planning for stabbing Israeli settlers, the sources added.
They were then taken to police station for investigation.

In al-Khalil, Israeli troops rounded up at least ten Palestinians including four in Beit Ummar town. Seven others were arrested in Ramallah and its towns including five Palestinians in Nabi Saleh town. The forces also arrested an ex-detainee university student and member of students’ council at Birzeit University, Suhaib Rabee, after storming his house.

The Palestinian Detainees' Committee has reported, Tuesday, that the number of Palestinians, including children, who have been kidnapped by Israeli soldiers since the beginning of this month has arrived to 1083; 44 of them kidnapped on Tuesday.
The Committee said among the 1250 Palestinians kidnapped since the beginning of this month are 643 from occupied Jerusalem.
It added that 55% of the kidnapped Palestinians are children, between the ages of 12 and 17, while approximately 200 of them are from Jerusalem.
Israel also placed 23 detainees from Jerusalem under arbitrary detention orders, holding them captive without charges or trial.
The number of female prisoners held by Israel is 36, including a few who were wounded prior to their arrest, and are now in Israeli hospitals.
The Detainees' Committee also stated that undercover Israeli soldiers shot and wounded several Palestinians, after arresting them, including Othman Ziyada, Ahmad Hamed and Abdul-Rahman Abu ath-Thahab.
It said that shooting residents after their arrest, and after they have been completely subdued, is a direct violation of all international laws and regulations, including the Rome Rome Statute, and the principles of the International Criminal Court.
In addition, the Committee said that all detained Palestinians have been beaten and assaulted, in addition to being subject to verbal abuse while many were attacked by military dogs that were let loose on them.
Many detainees suffered serious wounded after being beaten with batons, or kicked and punched, while many were left without any medical attention.
Some of the wounded Palestinians died due to the lack of adequate and urgently needed medical attention.
Ten Palestinians are currently receiving treatment in Israeli hospitals; four of them are women identified as Isra’ ‘Aabed, Estabraq Ahmad Nour, 15, Israa Ja’abees and Marah Bakeer.
Several Palestinians have been kidnapped for expressing their opinions on their social network accounts, and are facing what Israel calls “incitement charges,” while many Israelis, including officials, who call for killing Palestinians or describe them as snakes, as well as many other outrageous comments and posts remain at large.
Many Israeli officials, including the “Education Minister,” have even called on the Israelis to carry arms and shoot to kill.
Many Palestinians have been imprisoned under Administrative Detention because of their opinions and posts on social network sites.
Some of the recent decisions by the Israeli government allow imposing prison terms as high as twenty years against Palestinians, including children, believed to be behind attacks against Israelis, including stone throwing and Molotov cocktails.

Some of the kidnapped have been identified as Nabil Hammad Abu Mariya, Mohab Ibrahim Issa Bahar, Mohammad Ayesh Khalil Abu Mariya, Mohannad Ayes Khalil Abu Mariya, Hotheifa Haitham Tarayra, Mohammad Akef Manasra, Mo’tasem Faraj Obeido, Jalal Robin Shweiki, Rani Jihad Rajabi, Naim Abdul-Hafith Rajabi, Monatser Mohammad Rajabi, Mohammad Fakhri Rajabi, Fadi Hazem Rajabi and Majdi Wael al-Ajlouni.
The soldiers also kidnapped eight Palestinians in the Ramallah and al-Biereh District; they have been identified as Ashraf al-Khalili and Mohammad Suheil, from Betunia town, Rafat Tal’at Issa from Kafr Ein, Saddam Abdul-Razeq Tamimi, Yazan Issam Tamimi, Walid Abdul-Hafith Tamimi and Osama Samih Tamimi, from Nabi Saleh, and Soheib Rabea’ from al-Mazra’a al-Gharbiyya.

They have been identified as Ahmad Ezzeddin Amarna, Qais as-Sa’adi, Taher Jaradat, Saif Huwwari, Ahmad Qarariyya, Luay Abbas and Mohammad Qarariyya.
It added that the soldiers have also kidnapped three Palestinians, identified as Amir Mofeed Foqaha, Ibrahim Said, and former political prisoner Hamza Ya’ish, in the northern West Bank city of Nablus.

The soldiers also kidnapped eight Palestinians in the Ramallah and al-Biereh District; they have been identified as Ashraf al-Khalili and Mohammad Suheil, from Betunia town, Rafat Tal’at Issa from Kafr Ein, Saddam Abdul-Razeq Tamimi, Yazan Issam Tamimi, Walid Abdul-Hafith Tamimi and Osama Samih Tamimi, from Nabi Saleh, and Soheib Rabea’ from al-Mazra’a al-Gharbiyya.
The Committee also stated that the Israeli soldiers have kidnapped seven Palestinians from Jenin, in the northern part of the West Bank.
They have been identified as Ahmad Ezzeddin Amarna, Qais as-Sa’adi, Taher Jaradat, Saif Huwwari, Ahmad Qarariyya, Luay Abbas and Mohammad Qarariyya.
It added that the soldiers have also kidnapped three Palestinians, identified as Amir Mofeed Foqaha, Ibrahim Said, and former political prisoner Hamza Ya’ish, in the northern West Bank city of Nablus.

Two of the kidnapped are former political prisoners, identified as Nabil Hammad Abu Mariya, 30, and Mohab Ibrahim Issa Bahar, 21.
The soldiers also kidnapped Mohammad Ayesh Abu Mariya, 17, and Mohannad Ayesh Abu Mariya, 15 years of age, in the town, and summoned their brother, Malek, only eleven years of age, in addition to Ahmad Khalil Hashem, 48, for interrogation in the Etzion military base.

The Israeli occupation forces (IOF) on Monday evening kidnapped the son of senior Hamas official Sheikh Izzuddin Amarneh on a road near Yabud town in Jenin.
Local sources told the Palestinian Information Center (PIC) that the IOF set up a roadblock on the road between Yabud town and Tulkarem and kidnapped Ahmed Amarneh as he was heading home from his university in Tulkarem.
They added that the IOF took Amarneh to an undeclared place.

The Israeli Prison Services (IPS) closed Monday three sections in Nafha prison for allegedly finding a hole in a window, Palestinian rights group said.
The IPS claimed that it failed an escape attempt by the prisoners, the Palestinian Prisoners Society (PPS).
A state of tension has prevailed in the prison following the Israeli decision to close the three sections.
The IPS also declared its intension to move all the prisoners who were held in the three sections to other jails.
Jihad Movement’s prisoners affirmed that IPS forces brutally stormed Monday morning their sections and carried out a violent and provocative search campaign under the pretext of mobile phone infiltration.
The raid deepened the deteriorating situation in the prison, the prisoners added, pointing out that the prisoner Mohamed Issa was moved to solitary confinement.
The prisoners threatened to declare escalatory steps if the IPS did not retreat its punitive measures.
Mobile phone infiltration is an Israeli charge usually used to impose tight restrictions and punitive measures on Palestinian prisoners.

The prosecution claimed that Omar also knew his brother was in possession of a gun.

Ahrar Center for Prisoners and Human Rights disclosed that Israeli Occupation Authority (IOA) sentenced the Hamas leader MP Hassan Yusuf to administrative detention for six months.
Sheikh Hassan Yusuf, 60, was arrested after storming his house in Beitounia town in Ramallah a few days ago within an Israeli arrest campaign against 80 of Hamas leaders in the West Bank.
Yusuf was released from Israeli jails last July after serving a one year imprisonment under administrative detention, without trial or charge.
Ahrar center pointed out that IOA continues detaining five MPs of the Palestinian Legislative Council. They are Marwan al-Berghouthi, Ahmad Saadat, Mohammad Jamal al-Natsheh, Khaleda Jarrar and Sheikh Hassan Yusuf.

Yusuf was released from Israeli jails last July after serving a one year imprisonment under administrative detention, without trial or charge.
Ahrar center pointed out that IOA continues detaining five MPs of the Palestinian Legislative Council. They are Marwan al-Berghouthi, Ahmad Saadat, Mohammad Jamal al-Natsheh, Khaleda Jarrar and Sheikh Hassan Yusuf.

A human rights group has raised alarm bells over the sharp decline in the health status of the two Palestinian detainees Miqdad al-Heih and Mohamed al-Shalalda, both shot and injured by the Israeli occupation troops earlier this month.
A lawyer from the Palestinian Prisoners Society said, following a visit he paid to the injured detainees at the Hadassah Ein Kerem hospital, that prisoner Miqdad al-Heih and Mohamed Shalalda underwent head surgeries afternoon Saturday.
The two detainees have also been diagnosed with chest wounds. Both have been held in an intensive care unit in the Hadassah hospital in a very critical condition.
Both al-Heih and Shalalda were shot and injured by the Israeli occupation forces in two separate attacks earlier this month.

Detainee Abdul-Fattah Doula, representative of child detainees in Ofer Israeli Prison, told a lawyer of the Palestinian Detainees' Committee Israel is holding captive 100 children in Ofer Prison, and that all of them were kidnapped this month.
Doula added that this number was a %400 increase in the number of child detainees, adding that 40 of the detained 100 children in Ofer are below the age of 16, including 13 years of age child.
He also said that 22 children were beaten and tortured, including assaults against them during the course of their arrest; many were attacked by army bogs, and others were tortured with electric shocks, in addition to being subject to ongoing verbal abuse.
The Detainees' Committee said torture marks could be seen on the bodies of many child detainees.
About 60% of the children were taken prisoner after the soldiers invaded their homes, and five of them were shot and injured prior to their arrest.
The Israeli Prison Authority also transferred 70 detained children to Majeddo Israeli prison, and opened a new section for child detainees in Givon prison.
The Committee also said the army has kidnapped nearly 1000 detainees since the begging of this month, half of them were children, and that most of them are from occupied Jerusalem.

Local sources said that the IOF closed the entrances to Murad village between Nablus and Salfit and raided homes in the area.
The Hebrew media, for their part, claimed that the Israeli army arrested the Palestinian young man who stabbed a settler on highway 5 near the settlement of Ariel in Salfit on Sunday afternoon.
The settler was badly injured in the upper area of his body, according to the Israeli claims.
